Terms & Conditions

These Terms & Conditions govern the use of the Namma oor website and applications by customers, vendors and delivery partners.

Please read this document carefully. By using the Namma oor Platform you agree to the terms set out below.

1.Introduction and Acceptance

These Terms & Conditions (“Terms”) govern your access to and use of the Namma oor website, the Namma oor customer application, the Namma oor vendor application and the Namma oor delivery partner application (together, the “Platform”), operated by Namma oor (“Namma oor”, “we”, “us” or “our”).

By accessing the Platform, creating an account, placing an order or raising a service request, you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy and Refund & Cancellation Policy. If you do not agree, please do not use the Platform.

2.Definitions

  • “Customer” means a person who uses the Platform to order products or book services.
  • “Vendor” means a milk supplier, water supplier, electrician, plumber or other local business or service provider listed on the Platform.
  • “Delivery Partner” means a person who accepts and completes deliveries through the Platform.
  • “Order” means a request placed by a Customer for a product listed on the Platform.
  • “Service Request” means a booking raised by a Customer for a service such as electrical or plumbing work.
  • “User” means any Customer, Vendor or Delivery Partner using the Platform.

3.Eligibility and Account Registration

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Platform. By registering, you confirm that the information you provide is true, accurate, current and complete, and you agree to keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account. Please notify us immediately if you become aware of any unauthorised use of your account.

Vendors and Delivery Partners may be asked to submit additional documents for verification before they are allowed to operate on the Platform. We may accept or decline any registration at our discretion.

4.Nature and Scope of the Platform

Namma oor operates a hyperlocal marketplace that connects Customers with Vendors and Delivery Partners in their area. Namma oor acts as an intermediary and technology platform. Products are sold, and services are performed, by independent Vendors.

Unless expressly stated otherwise, Namma oor does not manufacture, sell, store or supply any product, and does not itself perform any electrical, plumbing or other service. The contract for the supply of a product or the performance of a service is between the Customer and the Vendor.

Availability of products, services, Vendors and Delivery Partners depends on your location and may change without notice.

5.Orders, Bookings and Service Requests

When you place an Order or raise a Service Request, you are making an offer to the relevant Vendor. The Order or Service Request is confirmed only when it is accepted by the Vendor through the Platform.

You must provide an accurate delivery or service address, a working contact number and any information needed to complete the Order or Service Request. Delays or failures caused by incorrect details are not the responsibility of Namma oor.

For service bookings, the final scope, materials and charges may be confirmed by the Vendor after inspecting the work at your location. You may decline the work before it begins if you do not agree with the revised scope or charges, subject to any visit charge that may apply.

Estimated delivery and service timings shown on the Platform are indicative and are not guaranteed.

6.Pricing, Charges and Taxes

Prices for products and services are set by Vendors and are displayed on the Platform before you confirm an Order or Service Request. Prices may change from time to time.

The amount payable may include delivery charges, service or visit charges, packaging charges, convenience fees and applicable taxes. All such charges are shown to you before payment or, for services priced after inspection, are confirmed by the Vendor before the work begins.

All amounts are payable in Indian Rupees (INR) unless stated otherwise.

7.Payments

The Platform may support online payments through third-party payment gateways as well as cash or other payment on delivery, where offered. Namma oor does not store your complete card, UPI or net banking credentials.

Online payments are processed by third-party payment service providers and are subject to their terms and policies. Namma oor is not responsible for any failure, delay or error caused by a payment service provider, a bank or a network.

If a payment is deducted but the Order or Service Request is not confirmed, the amount will be refunded in accordance with our Refund & Cancellation Policy.

8.Delivery

Deliveries are made by Vendors or by Delivery Partners to the address you provide. Someone must be available at the address to receive the Order.

If a delivery cannot be completed because you are unavailable, the address is inaccessible or incorrect, or you refuse to accept the Order without valid reason, the Order may be marked as undelivered and charges may apply as set out in the Refund & Cancellation Policy.

Please check perishable products such as milk and drinking water at the time of delivery and report any issue immediately.

9.Cancellations, Refunds and Returns

Cancellations, refunds, returns and replacements are governed by our Refund & Cancellation Policy, which forms part of these Terms.

10.Vendor Obligations

Vendors are independent businesses and are solely responsible for the products they sell and the services they perform. Each Vendor agrees to:

  • hold and maintain all registrations, licences, permits and skills required by law for its business;
  • list products and services accurately, including price, quantity, description and availability;
  • supply products that are genuine, safe, of acceptable quality and, where applicable, within their shelf life;
  • perform services with reasonable skill and care and within the agreed time;
  • accept, process and fulfil Orders and Service Requests it has confirmed;
  • comply with all applicable laws, including food safety, drinking water, electrical safety, consumer protection and tax laws; and
  • not solicit Customers to transact outside the Platform.

Vendors are responsible for their own tax obligations arising from sales made through the Platform.

11.Delivery Partner Obligations

Delivery Partners are independent contractors and are not employees of Namma oor. Each Delivery Partner agrees to:

  • hold a valid driving licence, vehicle registration, insurance and any other document required by law;
  • follow all traffic and road safety rules;
  • handle products with care and maintain hygiene, particularly for milk and drinking water;
  • deliver only to the address recorded in the Order and update the delivery status honestly; and
  • behave courteously and professionally with Customers and Vendors.

12.User Conduct and Prohibited Activities

You agree not to use the Platform to:

  • provide false, misleading or fraudulent information;
  • impersonate any person or misrepresent your association with any person or business;
  • place fake, abusive or repeated fraudulent Orders or Service Requests;
  • harass, threaten or abuse any Customer, Vendor, Delivery Partner or our staff;
  • upload any content that is unlawful, obscene, defamatory or infringes the rights of others;
  • attempt to gain unauthorised access to the Platform, or introduce any virus or harmful code; or
  • copy, scrape, reverse engineer or commercially exploit any part of the Platform without our written permission.

13.Intellectual Property

The Platform, including its design, text, graphics, illustrations, logos, icons, software and the “Namma oor” name and marks, is owned by or licensed to Namma oor and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable and revocable licence to use the Platform for its intended purpose. No other right or licence is granted.

Content submitted by Vendors, such as product images and descriptions, remains the responsibility of the relevant Vendor, who grants us a licence to display it on the Platform.

14.Third-Party Links and Services

The Platform may contain links to third-party websites, applications or services, including payment gateways and map or navigation providers. We do not control and are not responsible for the content, policies or practices of any third party. Your use of a third-party service is governed by that party's own terms.

15.Disclaimers and Limitation of Liability

The Platform is provided on an “as is” and “as available” basis. While we work to keep the Platform accurate and available, we do not warrant that it will be uninterrupted, error free or free of viruses, or that any listing, price or availability shown is free of error.

Namma oor is not a party to the contract between a Customer and a Vendor and is not liable for the quality, safety, legality or timeliness of any product supplied or service performed by a Vendor, or for any act or omission of a Vendor or Delivery Partner.

To the maximum extent permitted by law, Namma oor shall not be liable for any indirect, incidental, special, punitive or consequential loss, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Platform.

To the maximum extent permitted by law, our total aggregate liability in relation to any Order or Service Request shall not exceed the amount actually paid by you for that Order or Service Request.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, including under consumer protection law.

16.Indemnity

You agree to indemnify and hold harmless Namma oor, its directors, officers, employees and agents from and against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.

17.Suspension and Termination

We may suspend or terminate your access to the Platform, in whole or in part, with or without notice, if we reasonably believe that you have breached these Terms, engaged in fraudulent or unlawful activity, or created risk or legal exposure for us, other Users or the Platform.

You may stop using the Platform at any time and may request deletion of your account as described in our Privacy Policy. Termination does not affect any rights or obligations that arose before it.

18.Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Platform you consent to that collection and use.

19.Grievance Redressal

If you have a complaint about the Platform, an Order or a Service Request, please contact our support team first. Complaints that remain unresolved may be escalated to our Grievance Officer.

We aim to acknowledge complaints within a reasonable time and to resolve them in accordance with applicable law.

20.Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Subject to any right you may have under applicable consumer protection law, the courts having jurisdiction over the location of the registered office of Namma oor shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

21.Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, our business or the law. The revised Terms take effect when published on this page, and the “Last Updated” date above will be changed. Your continued use of the Platform after that date means you accept the revised Terms.
